Welcome to PT. Bintang Anarki Jayaa Abadi (BAJA)
This Terms and Conditions document ("T&C") governs your relationship with us regarding the purchase of products or services we provide. By making a transaction or interacting with us, you are deemed to have read, understood, and agreed to all of these T&Cs.
1. General
1.1. Party:
"We" or "PT. Bintang Anarki Jayaa Abadi" is a company
established under the laws of the Republic of Indonesia. "You" or
"customer" refers to individuals or business entities who make
transactions or interact with us.
1.2. Scope: These
T&Cs apply to all sales of products and services that we offer, either directly or through other distribution channels, only through the WhatsApp mobile

1.3. Changes to Terms & Conditions: We reserve the right to change these Terms & Conditions at any time without prior notice. Changes will be effective upon publication at https://bajaexport.com/term-conditions/. By continuing the transaction after the changes, you are deemed to have agreed to the updated Terms & Conditions.
2. Products and Prices
2.1. Product Description: We strive to provide accurate product descriptions, including
specifications, quality, and availability. However, minor differences may occur
due to natural factors, production processes, or screen displays.
2.2. Product
Availability: Product availability is subject to change at any time. We will
notify you if the ordered product is available or unavailable.
2.3. Price: The product price notified by the admin is the ex-works price, unless otherwise stated. The price does not include shipping costs, insurance, special request treatment, or applicable taxes, unless explicitly stated, and we reserve the right to change the price at any time.
3. Ordering and Payment
3.1.Order Procedure:
An order is considered valid after we receive confirmation of the order from
you (for example, via the order form, email, WhatsApp, or online ordering
system), and after that, a letter of agreement or work contract will be made
between the two parties, which is bound by the force of international trade law.
3.2. Payment: Payment
must be made in accordance with the agreed method (for example, bank transfer,
letter of credit, or other payment method). Orders will not be processed or
shipped until full payment is received, unless there is a prior written
agreement.
3.3. Order Cancellation: Cancellation of an order by the customer after confirmation may be subject to a cancellation fee or penalty, depending on the stage of order processing. Cancellation by the company may occur for reasons such as unavailability of stock or failure to pay.
4. Delivery and Receipt of Products
4.1. Delivery Schedule:
We will endeavour to deliver the product according to the agreed schedule.
However, delivery times are only estimates and may change due to factors beyond
our control (for example, weather conditions, transportation problems, and
force majeure).
4.2. Shipping Costs:
Shipping costs will be communicated to the Customer before order confirmation and
are the responsibility of the Customer, unless otherwise agreed.
4.3. Risk: The risk of
damage or loss of the product passes to the customer upon delivery of the
product to the carrier or upon delivery of the product to the customer,
whichever occurs first.
4.4. Product Inspection: The customer is required to check the condition and quantity of the product upon receipt. Any claims regarding damage or shortage must be notified to us in writing within [3] business days after receipt of the product.
5. Return or Discount Guarantee
5.1. Quality Guarantee:
We guarantee that the products we sell meet applicable quality standards and
are in accordance with the description provided.
5.2. Product Returns:
Product returns can only be made if the product is defective, does not match
the order, or does not meet the promised quality standards. Requests for
returns must be submitted within [3] days after receipt of the product,
accompanied by adequate evidence.
5.3. Return/Discount Procedure: Returned products must be in original condition, unused (except for quality claims), and accompanied by their original packaging. Return shipping costs may be the responsibility of the customer, depending on the reason for the return, or we will provide a price discount that has been agreed upon by both parties.
6. Limitation of Liability
6.1. We shall not be
liable for any indirect loss, consequential loss, loss of profits, or other
damages arising out of or in connection with the use or inability to use our
products or services, except as required by law.
6.2. Our maximum liability to you, in any event, shall not exceed the total amount paid by you for the relevant product or service.
7. Force majeure
We shall not be liable for any delay or failure in fulfilling our obligations under these T&Cs caused by events beyond our reasonable control, including but not limited to acts of God, war, riots, pandemics, government action, strikes, or infrastructure failures 8. Dispute Resolution
8. Dispute Resolution
8.1. Negotiation: Any
dispute or difference of opinion arising out of or in connection with these
T&Cs shall be resolved first through mutual negotiation.
8.2. Jurisdiction: If the deliberation fails to reach an agreement, the dispute will be resolved through the competent court at the Central Jakarta Court with the address Jalan Bungur Besar Raya No. 24, 26, 28, RT.28/RW.1, South Gunung Sahari, Kemayoran, Jakarta 10610, Republic of Indonesia.
9. Governing Law
These T&Cs are governed by and construed in accordance with the laws of the Republic of Indonesia.
10. Miscellaneous
10.1. Severability: If
any provision of these T&Cs is deemed invalid or unenforceable, such
provision will be deemed severable and will not affect the validity of the
remaining provisions.
10.2. Entire Agreement:
These T&Cs constitute the entire agreement between you and us regarding the
subject matter hereof and supersede all prior agreements, communications, and
proposals, whether oral or written.
By continuing to
transact with us, you declare that you have read and agree to all points in
these Terms and Conditions.
